We collect information you provide through our Recovery Portal — full legal name, entity or organization, email address, phone number, and a description of the potential claim. We also collect information gathered during the forensic recovery process, including records sourced from public and licensed databases used to locate and verify unclaimed capital.
Your information is used to evaluate and pursue recovery of surplus funds on your behalf, to contact you regarding your case, to verify identity and ownership, and to fulfill regulatory and contractual obligations. We do not share your phone number or contact information with third parties for their own marketing purposes.
By providing your phone number on our Recovery Portal and checking the consent box, you authorize Viable Surplus Recovery to contact you via SMS text messages, automated telephone calls, and prerecorded messages. These messages may include marketing and promotional content as well as service-related communications such as inquiry responses, appointment reminders, claim status updates, and documentation requests. Message and data rates may apply. Message frequency varies. You may opt out of SMS communications at any time by replying STOP to any message, or by contacting us at recovery@viablesurplus.com. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. We retain opt-out preferences and will not message you after you withdraw consent, except where required to complete an active engagement.
We may share your information with affiliated recovery specialists, licensed skip-tracing providers, and legal counsel engaged to advance your claim, and only as necessary to pursue your recovery. We do not share your phone number or contact information with third parties for their own marketing purposes. Disclosure may also occur where required by law, court order, or to protect our rights and the rights of our clients.
We employ administrative, technical, and physical safeguards designed to protect your information. Access is restricted to authorized personnel involved in your case. No system is perfectly secure, but we apply industry-standard controls consistent with the sensitivity of financial recovery work.
We retain case information for the duration of your engagement and for a reasonable period thereafter as required for recordkeeping, dispute resolution, and regulatory compliance.
You may request access to, correction of, or deletion of your personal information, subject to legal retention requirements. To exercise these rights, contact us at recovery@viablesurplus.com.
We may update this policy as our practices evolve. Material changes will be reflected on this page with an updated revision date.
